Résumé

Durant les années weimariennes, Carl Schmitt et Walter Benjamin posent la question de l’origine de l’ordre juridico-politique, ainsi que celle de sa préservation. Les deux auteurs semblent s’accorder sur le fait que la fondation de l’État de droit résulterait toujours d’un acte de violence. Tandis que Benjamin caractérise ce geste inaugural de "violence fondatrice de droit", Schmitt soutient l’idée qu’une "décision politique" originelle qui incomberait au pouvoir constituant serait à la racine de tout ordre juridique. Se déclinant sous la forme de mesures d’exception, la violence se ferait ensuite "conservatrice de droit", elle chercherait à maintenir en l’état l’ordre institué. Cet article vise ainsi à éclairer l’importance que revêt la notion de violence dans les réflexions développées par ces deux penseurs allemands au cours des années 1920.

Abstract

During the Weimar period, Carl Schmitt and Walter Benjamin posed the question of the origin of the politico-legal order, as well as that of its preservation. Both authors seem to agree on the fact that the foundation of the rule of law is always the result of an act of violence. While Benjamin characterizes this inaugural act as “law-making violence”, Schmitt supports the idea that there is an elementary “political decision”, incumbent upon the constituent power, which is at the root of every legal order. Initially taking the form of emergency measures, violence would thereafter establish itself as “law-preserving”, and would from then on seek to maintain the established state order. This article aims to illuminate the importance of the concept of violence in the reflections developed by these two German thinkers during the 1920s.
